General Terms and Conditions of Sale

Effective as of June 25, 2025

1. Scope of Application

These General Terms and Conditions of Sale (GTCS) govern the graphic design services provided by the contractor operating under micro-entrepreneur status. Any order implies full and unconditional acceptance of these terms, which prevail over any other document.

2. Service Provider Identity

This website is published by Cameron Manzenza, sole proprietor (EI), micro-enterprise registered with the Trade and Companies Register of Le Mée-sur-Seine under SIRET number 990 577 124 00011.

3. Orders & Quotations

All services are subject to a detailed quotation specifying the content of the selected offer, total price (incl. tax), deadlines, payment terms, and transfer of rights. A signed quotation constitutes a binding agreement. No work will begin without a signed quotation and the payment of the deposit.

4. Pricing & Payment

Prices are expressed in euros, all taxes included. VAT not applicable (Article 293 B of the French Tax Code).
Payment is made via bank transfer under the following terms:

  • Éclosion Offer: 30% upon order, 70% upon delivery

  • Envol Offer: 50% upon order, 50% upon delivery

The remaining balance is due within 7 days after final delivery.

Late Payment Penalties
In case of late payment, the client will be liable for penalties calculated at three times the current legal interest rate, without prior notice, in accordance with Article L441-10 of the French Commercial Code.
A fixed compensation of €40 for recovery costs will also be required (Article D441-5 of the French Commercial Code).

 

5. Deadlines & Responsiveness

The indicated deadlines are estimates and depend on the client’s responsiveness in validating intermediate stages. Any unjustified delay in client feedback may result in a postponement of the service.

 

6. Delivery & Formats

Deliverables are provided in digital format (PDF, PNG, SVG). Source files are delivered only after full payment of the outstanding balance.

7. Revisions

Each offer includes two rounds of revisions after the logo presentation. Any additional requests will be subject to a supplementary quotation.

8. Transfer of Rights

Commercial usage rights are transferred only after full payment of the service. The contractor reserves the right to showcase the work for communication purposes (portfolio, social media, etc.), unless otherwise agreed in writing by the client.

9. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to customized services once work has begun, except in exceptional cases agreed upon by the contractor.

10. Legal Guarantees

Services benefit from the legal guarantees provided under Articles L217-4 to L217-14 of the French Consumer Code (compliance) and Articles 1641 to 1649 of the French Civil Code (hidden defects), within the limits specific to digital creations.

11. Personal Data Protection (GDPR)

Personal data collected (name, email, form responses) is necessary for order management.
It is retained for 3 years from the end of the contractual relationship.
In accordance with GDPR, the client has the right to access, rectify, delete, restrict, and object to the processing of their data.

12. Contract Archiving

A copy of the signed quotation, invoice, and GTCS is provided to the client in PDF format and must be stored on a durable medium.
The contractor also archives all documents for 5 years.

13. Disputes & Mediation

In the event of a dispute, the parties will first seek an amicable solution.
Failing that, the dispute will fall under the jurisdiction of the competent French courts.

In accordance with Articles L612-1 to L616-3 of the French Consumer Code, the client may use a consumer mediator free of charge.

14. Force Majeure

Neither party shall be held liable in the event of force majeure (Article 1218 of the French Civil Code).
This includes: fire, natural disasters, network outages, serious illness of the contractor, war, strikes, etc.

15. Applicable Law & Language

These GTCS are drafted in French and governed by French law.
In the event of translation, only the French version shall prevail.
